These Terms of Service (“Terms”) govern your access to and use of the Down The Hall mobile application and related services (the “Service”) provided by Down The Hall (“we,” “our,” or “us”).
By downloading, installing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.
1. Acceptance of Terms
By downloading, registering for, or using Down The Hall, you agree to these Terms of Service. These Terms constitute a legal agreement between you and Noah Roelofsen, Ontario, Canada.
2. Who Can Use Down The Hall
To use the Service, you must:
- Be 18 years of age or older
- Be a current resident of the building you register under
- Provide accurate and truthful registration information
- Maintain only one account per person
Providing false information will result in immediate account termination.
3. Account Registration and Approval
All registrations are manually reviewed. We reserve the right to approve or reject any application at our sole discretion. Your full name, handle, email address, and building address are locked after approval and cannot be changed without contacting us.
4. Your Content
You are solely responsible for all content you create on the Service. By posting content, you confirm that you own it, that it does not violate any applicable law, and that it complies with our Community Guidelines.
You grant us a limited, non-exclusive licence to store and display your content solely to operate the platform. We do not claim ownership of your content.
5. Prohibited Conduct
The following are prohibited and may result in immediate suspension or permanent termination:
- Abusive, threatening, harassing, defamatory, or discriminatory content
- Sharing another person’s private information without their consent
- Impersonation of any person or entity
- Spam or commercial solicitation
- Interference with or disruption of the platform or its infrastructure
- Any unlawful use of the Service
- Creating or operating multiple accounts
6. Moderation and Account Termination
We reserve the right to remove any content at any time for any reason. We may suspend or permanently terminate any account at our sole discretion. Moderation decisions are final.
7. Auto-Deletion of Content
By using the Service, you acknowledge and accept the following automatic deletion schedule:
- Feed posts and comments: deleted 7 days after the post is created
- Chat messages: deleted 7 days after sent
- Group chats: deleted after 14 consecutive days of inactivity
8. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
9. Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind. We make no representations regarding the reliability, availability, or fitness of the Service for any particular purpose. We are not responsible for content posted by users.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Noah Roelofsen shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability to you for any claim shall not exceed $100 CAD.
11. Indemnification
You agree to indemnify and hold harmless Noah Roelofsen from and against any claims, damages, losses, or expenses (including reasonable legal fees) arising out of or relating to your use of the Service, your content, or your violation of these Terms.
12. Changes to These Terms
We may update these Terms from time to time. The “Last updated” date at the top of this page will reflect any changes. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.
13. Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts of Ontario, Canada.
